NOTICE TO LEGAL FIRMS
The City of Dubuque is requesting written proposals and qualifications for legal services from interested law firms to assist the City with the acquisition of an easement from the Canadian Pacific Railroad to install storm water culverts under the railroad right of way in its Bee Branch Creek storm water project. Additionally, the City requires assistance in obtaining appraisals related to real estate transactions to facilitate the Bee Branch Creek storm water project. The City requires a firm with expertise of Iowa code, railroad court cases and precedents, related state and federal law specific to railroads, on-going work with the Iowa Utilities Board, and experience with a minimum of two (2) of the four (4) Class 1 railroads operating in Iowa within the past five years. The firm must be familiar with construction law and micro-tunneling, the eminent domain process, environmental law, real estate acquisition, and the Surface Transportation Board (federal railroad regulatory agency) processes and procedures. The project is funded in part with state and federal funding and the acquisition process must comply with the applicable regulations.
